Terms of Service

These Terms govern your access to and use of Operator (the “Service”), an AI receptionist for service businesses. By using the Service you agree to these Terms. If you are using Operator on behalf of a business, you agree on its behalf.

1. The Service

Operator answers phone calls and website chats on your behalf, qualifies enquiries, and can book appointments and sync them to a connected calendar. Features may change over time as we improve the Service.

2. Accounts

You are responsible for your account, your login credentials, and all activity under your account. You must provide accurate information and keep it up to date.

3. Your responsibilities

  • You must use the Service lawfully and only for legitimate business communication.
  • Call recording and notifications: you are responsible for ensuring that callers are notified of AI handling and call recording where required by the laws applicable to you and your callers.
  • You are responsible for the accuracy of the business information, services, and availability you configure.
  • You must not use the Service to send spam, harass, deceive, or violate the rights of others.

4. AI-generated responses

The Service uses artificial intelligence to understand and respond to callers and visitors. AI can make mistakes or misunderstand requests. The Service does not provide professional, legal, medical, or financial advice, and you should review important outcomes (such as bookings and lead details). You are responsible for how you act on the information the Service provides.

5. Third-party services

The Service relies on third parties (including telephony, AI, voice, calendar, email, and hosting providers). Your use of connected third-party services (such as Google or Microsoft calendars) is also subject to their terms.

6. Fees

Where fees apply, they will be agreed with you separately. Usage-based costs (such as telephony, voice, and AI usage) may apply. Unless otherwise agreed, fees are non-refundable.

7. Availability

We aim to keep the Service available and reliable but do not guarantee uninterrupted operation. The Service is provided on an “as is” and “as available” basis without warranties of any kind, to the maximum extent permitted by law.

8. Limitation of liability

To the maximum extent permitted by law, Operator will not be liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data, arising from your use of the Service. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including under the Australian Consumer Law.

9. Termination

You may stop using the Service at any time. We may suspend or terminate access if these Terms are breached or to protect the Service or its users. On termination, your right to use the Service ends.

10. Governing law

These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.

11. Changes

We may update these Terms from time to time. Continued use of the Service after changes means you accept the updated Terms.
